The seller hereby explicitly declares and warrants that this commercial transaction is executed strictly as a charitable fundraising initiative and not for personal financial gain. In strict compliance with Section 52 of the Canadian Competition Act regarding promotional representations made to the public, the seller guarantees that one hundred percent (100%) of the net proceeds, legally defined as the gross sale profits, shall be directly transferred to a registered Canadian charity or eligible non-profit organization. To establish absolute financial transparency and prevent any deceptive marketing practices under provincial consumer protection legislation, the division between cost recovery and charitable donation is explicitly quantified and capped. The gross purchase price paid by the buyer will be utilized first and exclusively to recoup the strictly defined, actual out-of-pocket costs incurred during construction and delivery; these material expenses are fixed at exactly one hundred and seventy-eight dollars and eighty-two cents ($178.82) CAD for raw materials, plus the actual, verified third-party freight and shipping costs required to securely transport the instrument to the buyer. For administrative clarity and standard accounting precision, the cumulative total of these two actual costs (raw materials plus shipping) will be rounded up to the nearest whole Canadian dollar.
The seller explicitly waives all claims to financial compensation for personal labour, bench time, luthier expertise, design overhead, or operational efforts expended during the construction, finish, or sale of this instrument and accessories. Consequently, every dollar collected from the buyer exceeding the baseline rounded-up cost of raw materials and shipping constitutes the entirety of the net profit. This entire remainder will be distributed directly to the designated charitable organization, with zero structural deductions, administrative fees, or commissions withheld by the seller. Full financial documentation, including original invoices for raw materials where available, verified shipping manifests, and a certified receipt of the subsequent charitable donation from the recipient organization, will be maintained by the seller and made fully available to the buyer upon request to verify absolute compliance with this legal allocation framework.
